MacDermid files patent lawsuit against DuPont
MacDermid Printing Solutions announced that it has filed a patent infringement lawsuit against DuPont on a US patent relating to its digital photopolymer plate technology.
In the lawsuit, MacDermid claims that DuPont has manufactured, used, offered for sale and sold flexographic plates, including products marketed under the name DFH 45, DFM 45, DFM 67, and DPR 67, that are covered by a MacDermid US patent related to digital photopolymer plate technology. The suit also claims that DuPont has actively induced others to infringe through offers to sell, advertise and promote digital photopolymer plates.
MacDermid is seeking monetary damages and demanding that DuPont stop further acts of infringement associated with these products. The products named in the suit are photopolymer plates designed to work with DuPont’s Cyrel FAST thermal plate processor.
“MacDermid has made a substantial investment in developing its digital technologies and must protect this very important intellectual property,” says Timothy Gotsick, director of innovation at MacDermid.
This is not the first lawsuit involving the companies. In April 2006, DuPont filed a similar patent infringement lawsuit in US federal court against MacDermid claiming that MacDermid’s Magma and MLT products were in violation of a DuPont patent related to thermal flexographic technology. Then in October 2006, DuPont filed a motion for a preliminary injunction to stop sales of MacDermid’s LAVA thermal processing systems and equipment that were used to thermally develop or process flexographic printing plates. DuPont called those sales “continued infringement of patents” related to DuPont Cyrel FAST thermal technology.
